Attorneys within Arnstein & Lehr’s Product Liability Group are dedicated to the defense of product liability matters in strict liability (design, manufacturing defect, and failure to warn) negligence and implied warranty claims including those involving catastrophic injury and death, and do so on behalf of Fortune 500 manufacturers and distributors, as well as for mid-size companies, both domestic and international.
The Product Liability Group’s attorneys have successfully defended clients in state and federal courts and in multiple districts for decades, establishing a reputation for the aggressive defense of U.S. and foreign designers and manufacturers of products. Our representation includes all aspects of litigation, including pre-trial discovery (including e-discovery on both a small and large scale), preparing and arguing dispositive motions, trial work, alternative dispute resolution, and appeals in both state and federal courts.
Our attorneys have handled cases ranging from the defense of common household products to the most sophisticated, specialized machinery and scientific, automotive components, as well as medical devices.
Among the cases successfully defended by our Product Liability Group attorneys are suits involving catastrophic crashes of automobiles and SUV’s, motor coaches, buses, trucks, tractors, mining equipment, forklifts, aerial work platforms, riding and walk-behind mowers, farm equipment, snow throwers, pneumatic devices, power and hand tools, pharmaceuticals, medical devices, chemicals and petrochemicals, ship loading ramps, trenching equipment, well equipment, automatic sliding doors, and window coverings. In many of these instances, the allegations include inadequate warnings and/or the violation of various government regulations.
Our attorneys have significant expertise in the representation of automotive clients in litigation involving their cars and SUV’s. We have assisted our clients within this industry in the defense of vehicle components and systems, including occupant restraints, electronic control modules, airbags, roofs, seats, brake systems, glazing, transmissions, suspensions and door systems. The attorneys in the Group have years of experience defending automotive clients against claims for handling and stability, crashworthiness, rollovers, unintended acceleration, active and passive restraint systems, window glazing, fires, door latch integrity, warnings, welds, material composition and strength. In addition, our Group’s attorneys have wide-ranging experience defending a tire retailer in catastrophic crash cases.
