Miami Partners Jeffrey Shapiro and Neville Leslie recently authored "How to Keep the Smoking Gun From Burning Your Client," an article appearing in the January 7 issue of Andrews Litigation Reporter Medical Devices. Documents from the FDA and manufacturer's adverse-event reports are often seen as "smoking guns" during litigation. Shapiro and Neville explain why these materials should not be introduced to the jury at trial and how to combat the plaintiff's attempts to use the materials during litigation.
