Chicago Associate Adam Fayne's article, "Taxation of Lawsuit Recoveries," was published in the April-May 2008 edition of Journal of Tax Practice and Procedure. Adam's article examines the tax treatment of a recovery from a lawsuit.  He asserts that parties involved in litigation could mitigate undesirable and unintended tax consequences if only they were to think through a tax strategy prior to the conclusion of a law suit.  In his article, Adam offers a wealth of information to consider for parties involved in litigation.
